What North Dakota requires on your label

The label maker below handles all of this for you. Here is the checklist it follows, straight from North Dakota's rules.

   Required disclosure statement

   The exact wording below, on the product label OR on a consumer advisory sign at the point of sale. It is the only universally required label text in North Dakota (N.D.C.C. 23-09.5-02).

   For refrigerated/TCS products: safe handling instructions

   Plus a disclosure that the product was transported and maintained frozen, where applicable.

   Best practice: producer name and contact

   Not legally mandated, but customers and markets expect it.

   Best practice: ingredients and allergens

   Not legally mandated by the cottage food law, but listing ingredients in descending order and calling out the Top 9 allergens protects your customers and you.

• State and local agencies may not impose labeling requirements beyond the statute, so everything past the disclosure statement is best practice rather than law.
• SB 2386 (2025) added interstate shipping and phone/online orders without changing the disclosure wording.
• If you sell unpackaged items at a farmers market or pop-up, the disclosure can be a sign at the point of sale.
